1. Parties involved

These terms and conditions of delivery form part of all agreements and apply to all (other) acts and legal acts between Hans van Dijk Exploitatie, the seller, from whom you (business buyer) order products via this website, and you, even if these (legal) acts do not lead to, or are not related to, an agreement.

 

1.1 Business buyer and private buyer

Business buyers are those who demonstrably place orders on behalf of a company, association, or foundation and have identified themselves as such in communications. A private buyer is always a natural person. (private individual)

  

1.2 Reservation for private buyers

The web shops: www.slushsiroop.nl is intended for both business buyers and private buyers.

 

2. Conclusion of agreement

An agreement is concluded when the buyer, via one of the seller's websites, has ordered one or more products and has received the order confirmation for this order from the seller electronically. The order confirmation is deemed to have been received when it is accessible to you.

 

3. Offers

3.1 All offers on this website are without obligation. Offers are subject to the availability of ordered products. All images of products to be ordered are for indication only. The seller or the respective supplier is not liable for deviations of any kind.

 

4. Payment methods

Seller accepts the following payment methods:

Offline payment methods, namely cash payment and prepayment by bank/giro transfer.

The buyer can also pay online using: iDEAL, Visa, Mastercard, V-Pay, Maestro, and other offered payment methods.

For customers from Belgium, Bancontact/MrCash Online is also available.

 

5. Product prices

All prices indicated on our website are in euros and listed both including and excluding Dutch VAT.

If you are a customer located in an EU country other than the Netherlands, you can purchase from us without paying VAT. Please enter your country's VAT number in the checkout. The VAT verification tool "live" checks the validity of your VAT number. Unfortunately, it is not possible to amend invoices that include VAT afterwards. For any questions, please contact us by email.

All offers/images/prices are subject to typing/scanning errors and/or changes by the manufacturer. (see general terms and conditions)

 

6. Delivery

6.1 Delivery of the products ordered by the buyer takes place by and under the responsibility of the seller whose product(s) the buyer has ordered.

 

6.2 The seller may charge you a sum for shipping and packaging costs for orders.

For items with extreme dimensions, we apply different delivery costs.

 

6.3.1 For in-stock items that can be sent with a parcel service, the seller's policy is to hand over the parcel to the shipping company on the same working day, or at the latest on the next working day.

 

6.3.2  Delivery times are indicative and not a strict deadline.

 

6.4 Seller is entitled to apply partial deliveries.

 

6.5 Seller is entitled to deliver to neighbors or to a parcel point if no one appears to be at home at the delivery address.

 

6.6.1 If the delivery address is not accessible by car throughout the day, the buyer must inform the seller in advance by making a note in the comments field during the ordering process or immediately by email or online form after the order has been placed.

 

6.6.2 If delivery cannot be made due to no fault of the seller, the seller may charge transportation costs again for a new delivery.

 

6.7 The statutory delivery period can be a maximum of 30 days, measured from the receipt date of payment or the guarantee by the financing company (post-payment).

 

6.8 Deliveries are made exclusively within the Netherlands, Belgium, and Germany, unless otherwise indicated on the websites.

 

6.9 For special orders or custom work, the delivery time can be up to a maximum of 26 weeks. For special orders, the seller may request an advance payment.

 

7. Cooling-off period - Distance Selling Act

7.1 After a private buyer has placed their order, they have the right to dissolve the underlying agreement with the seller within 14 calendar days thereafter. This is stipulated in the "Distance Selling Act".

 

7.2 If a private buyer wishes to dissolve the agreement pursuant to Article 7.1 of these terms and conditions, they must notify the seller in writing (via email, online form or letter). The private buyer must return the product within 14 days of receipt, accompanied by a fully completed return form, to the seller's address, Vitus Beringstraat 22, 7825 AJ Emmen, Netherlands.  Food items with a best-before date can never be returned.

 

7.3 The buyer must bear the costs and risk of return shipping themselves.

 

 

7.4 If the buyer has already made any payments at the time they revoked the agreement with the seller pursuant to Articles 7.1 and 7.2 of these terms and conditions, the seller will refund these payments to the buyer within 14 calendar days after the seller has received the product returned by the buyer.

 

7.5 The seller reserves the right to refuse returned products or to credit only a portion of the amount already paid if there is a suspicion that the product has already been opened, used, or damaged due to your fault (other than that of the seller or the product's supplier).

 

7.6 If a product is returned that, in the seller's opinion, has been damaged due to an act or omission of the buyer, or is otherwise at your risk, the seller will notify the buyer in writing (via letter or email). The seller has the right to deduct the depreciation of the product resulting from this damage from the amount to be refunded to the buyer. Returns of items where the packaging has been opened or seals have been damaged will not be accepted.

 

7.7 Items excluded from return are all items that can be used in a direct food environment, due to hygiene considerations.

Also excluded from return are items specially ordered, manufactured or adapted for the customer.

 

8. Complaints

8.1 The seller is responsible for the products displayed and delivered by him, and their delivery. If the delivered product does not conform to the agreement, the seller will still deliver the missing items or, at his discretion, proceed with repair or replacement of the delivered product.

 

8.2 Upon receipt, the buyer must immediately unpack and inspect the delivered goods for defects and damage. If there are any defects or damage, the buyer should not accept the delivery. If delivery is made by an external delivery service and there are non-visible defects or damage, the buyer has 24 hours to notify the seller. This must be done via email or letter.

 

9. Liability

9.1 All offers/images/prices are subject to typing/scanning errors and/or changes by the manufacturer/supplier. The total liability of the seller due to an attributable failure in the performance of the agreement is limited to compensation for direct damage up to the amount you paid for the product, through or in connection with which the damage was caused; the total liability of the seller shall in any case be limited to a maximum of two thousand two hundred and fifty euros (EUR 2250.00). The seller's liability for indirect damage, including consequential damage, loss of profit, missed savings, and damage due to business interruption, is excluded. Otherwise, the seller has no liability for compensation, regardless of the basis on which an action for compensation would be based. These limitations of liability do not apply insofar as the damage is caused by intent or deliberate recklessness of the seller or insofar as they are contrary to provisions of mandatory law.

 

10. Method of Warranty Handling

If a customer wishes to claim warranty on an item, this must always be done in writing via email. The customer must substantiate their claim and preferably provide photos. At the seller's request, the customer must return the item claimed for warranty to the seller, where further investigation will take place. The costs of transport are always for the buyer. After the seller's request, the buyer has 14 days within which the item claimed for warranty must have been received back.

If the item is not received within this period, the seller will unilaterally terminate the handling of the warranty claim.

 

11. Retention of Title

All products supplied by the seller remain the property of the seller or its suppliers until the amount due under the Agreement with regard to those products has been paid in full, including any interest and collection costs.
